California FSBO Contract

California Residential Purchase Agreement and Joint Escrow Instructions (California Association of Realtors C.A.R. Form RPA-CA is a contract usually initiated by a buyer who is offering to purchase said property from the seller. This contract will layout the purchase amount, terms and contingencies in which the the buyer is offering to the seller. The contract will have an expiration time, usually 24 hours to 3 days time in which the seller can agree, counter or decline the offer. Once a mutual agreement is arrived, the offer becomes a binding contract and, time is of the essence for both the buyer and seller to perform. A purchase and sale agreement will also contain terms covering everything from financing options and earnest money to property condition and inspections. It is the seller’s duty, by law, to include all “State Required” disclosure notifying the buyer of any issues concerning the state of the property.
